SUMMARY:Cant You Just Put Out a Mediators Proposal
DESCRIPTION:This program will explore the mediator's proposal as a tool for breaking impasse and resolving disputes\, including how a mediator develops the proposal and determines when the time is right to make one. Lizbeth Hasse and Michael Timpane of JAMS will address strategies for incorporating non-monetary settlement terms and navigating the added complexities of mediator's proposals in multi-party cases. Presenters will also examine what happens when a mediator's proposal is unsuccessful and offer practical strategies for restarting negotiations and preserving opportunities for settlement.

SUMMARY:When Employees Blow the Whistle: Managing Employer Exposure Under the Federal And
DESCRIPTION:An internal complaint\, an unexpected subpoena\, or a sealed qui tam complaint can turn routine business into high-stakes litigation overnight. Whistleblowers who bring claims under the federal False Claims Act and the California False Claims Act can recover a large share of what the government collects. That gives employees strong reasons to report suspected fraud\, and employers face treble damages\, per-claim penalties and retaliation claims as a result. \n  \nThis program gives in-house counsel\, HR leaders\, and compliance professionals a practical look at how whistleblower claims start\, how they grow and how employers can protect themselves at every stage. Topics include: \n  \n\nHow qui tam cases work under federal and California law: filing under seal\, whether the government steps in\, and what that means for your organization.\nRetaliation risk: how anti-retaliation protections under the FCA\, the California FCA and related California whistleblower statutes affect discipline and termination decisions.\nHandling internal reports: when to investigate\, how to preserve privilege\, and how to avoid creating evidence that helps the plaintiff.\nBuilding a compliance program that holds up: reporting channels\, training and documentation that reduce exposure before a complaint is ever filed.\nLitigation and resolution strategy: early case assessment\, coordinating with the government\, and settlement points to consider.\n\n  \nLeave with concrete steps your organization can take now to spot red flags\, respond carefully when concerns come up\, and limit liability if a whistleblower comes forward.

SUMMARY:Regulating the AI Boom: California Passes a New Package of Laws That Change The
DESCRIPTION:California just became the latest state to turn up the heat on data center regulation in a move that could curtail the state’s positioning in the AI arms race. On September 21\, 2026\, Governor Gavin Newsom signed a package of seven new bills\, which he branded as “the most comprehensive data center laws in the nation.” Collectively\, the new bills seek to impose greater transparency and regulatory control over data centers’ electricity use\, water consumption\, and land use impacts\, while aiming to prevent infrastructure and generation costs from being shifted to existing ratepayers. Edgar Khalatian and Nedda Mahrou\, land use partners at Mayer Brown with extensive experience entitling data centers\, will walk through the key provisions of each bill. Attendees will come away better equipped to navigate California’s new regulatory framework in the data center space.

SUMMARY:Using Depositions as Substantive Trial Evidence Under Section 2025 620
DESCRIPTION:At trial\, deposition transcripts often sit in a box until someone needs a contradiction for impeachment\, but that testimony is worth so much more. C.C.P. section 2025.620 lets you put deposition testimony in front of the jury as substantive evidence\, including the testimony of any party employee who was employed when the deposition was taken\, the testimony of an unavailable witness\, and the videotaped testimony of your own expert or a treating physician. Jenna Edzant of Greene Broillet & Wheeler\, LLP walks through each subdivision and the objections opposing counsel raises against them. The program covers what “for any purpose” actually means\, how to build a record for unavailability starting at the deposition itself\, the exceptional-circumstances catch-all\, and the notice and designation requirements that decide whether the testimony comes in at all. Attendees will leave knowing the steps for maximizing the value of your deposition transcripts at trial.

SUMMARY:The Newly Passed SB 574: Regulating the Use of AI in the Practice of Law
DESCRIPTION:California is often on the cutting-edge of new laws and ethical rules\, particularly when it comes to overseeing the conduct of attorneys. With the passing of Senate Bill 574\, legal professionals’ use of generative artificial intelligence is now officially codified in California. The Bill and resulting new Business & Professions Code Section 6068\, and expanded Section 6173\, prohibit lawyers from delegating the practice of law to AI\, restrict sharing confidential information\, and impose new requirements of public disclosure\, among other requirements. \n  \nThis program will explore the boundaries of the new law as it relates to lawyers\, mediators\, arbitrators\, and judges. Attendees will leave with a clear understanding of the impact of these new regulations on their use of AI\, and the changes and practice guardrails they can employ to ensure they are in compliance.

SUMMARY:Building to Last: Land Use and Insurability in Californias Fire Country
DESCRIPTION:California's next housing decisions will be made in the shadow of fire risk\, and the hardest choices sit in the wildland urban interface\, where development pressure\, thin land use regulation\, and a strained insurance market collide. Lauren Ashley Week of Reuben\, Junius & Rose\, LLP and Dan Veroff of Merlin Law Group examine the problem from both sides of that collision\, moving between the land use framework that governs WUI development and the insurance reality that decides what can actually be built and rebuilt. On the land use side\, the discussion covers the regulatory framework\, the case for concentrating density near existing communities\, and the argument for limiting construction in the most hazardous zones. On the insurance side\, it covers the growth of the FAIR Plan\, the state's Sustainable Insurance Strategy\, forward-looking catastrophe modeling\, and how home hardening translates into coverage and rate outcomes. Responsibly reshaping where and how California builds is the long-term path forward\, yet none of it holds without an insurance market willing to write the risk. Attendees will leave with a working understanding of how land use and insurability shape each other and where the practical leverage points sit for building fire-resilient communities.

SUMMARY:Negotiating Indemnification Clauses in Game Development and Publishing Contracts
DESCRIPTION:Indemnification sits near the end of most game development agreements and gets a fraction of the attention paid to payment terms or IP ownership. When a claim lands\, that one paragraph decides who pays. Brandon J. Huffman of Odin Law and Media and general counsel to the International Game Developers Association\, and Ryan Fairchild of Odin Law and Media\, break down the three moving parts of every indemnification provision: the trigger\, the scope\, and control of the defense. They cover the patterns that signal a one-sided clause\, including first-party claims used to sidestep a liability cap\, uncapped obligations\, and broader indemnity language buried in an exhibit or schedule. Attendees leave with a checklist for reviewing these provisions and practical language for making obligations mutual without stalling the deal.

SUMMARY:Motions for Summary Judgment: Writing for Two Audiences
DESCRIPTION:Motions for summary judgment can serve multiple purposes short of a straightforward\, embattled "win." In fact\, the most favorable outcome possible with a motion for summary judgment is to end the case with no contest\, due to an opponent's prudent election to stand down. This means that the drafter of a motion for summary judgment needs to keep in mind that the intended audience is not only the judge who would issue a ruling if the motion is contested\, but perhaps even more importantly\, the target audience should be the receiving attorney who has to decide whether or not to oppose in the first place. Marshall J. Shepardson of Fraser Watson Croutch LLP presents a "once-around-the-track" survey of each stage of the MSJ process\, focused on the theory and mechanics of crafting a motion while keeping in mind both important audiences: the presiding judge\, who may ultimately decide the motion\, as well as the opposing attorney\, who may decide just to let this one go.

SUMMARY:Nuts and Bolts of Californias Principal Antitrust Law: The Cartwright Act
DESCRIPTION:California’s principal antitrust law\, the Cartwright Act\, prohibits unlawful restraints of trade. This program breaks down how it works: what counts as a contract\, combination\, or conspiracy in restraint of trade? which offenses are per se violations?\, and how to define relevant markets—an issue that often has dispositive importance in an antitrust case. William Markham of the Law Office of William Markham examines the Act\, its common-law origins\, its aversion to the consumer-welfare precepts that have greatly limited the reach of federal antitrust law in the modern era\, and key differences between the Act and its federal counterpart\, Section 1 of the Sherman Act. The discussion also covers the Act’s limits\, its connection to California’s law voiding non-compete covenants\, and recent developments\, including the Attorney General’s stated revival of criminal enforcement and the Legislature’s recent consideration of a law against monopolization and anticompetitive mergers. Attendees will leave able to spot viable Cartwright Act claims and understand why a challenge that fails in federal court can succeed in California state court

SUMMARY:Domestic Violence Restraining Orders: The Impact on Custody\, Co-Parenting\, and C
DESCRIPTION:Domestic Violence Restraining Orders carry immediate and profound consequences in family law proceedings\, particularly where custody is at issue. This presentation examines the evolving role of DVROs in custody disputes\, with a focus on what happens after the order is issued or denied. Hon. Joshua Wayser (Los Angeles Superior Court)\, Michael B. Hanasab of Jamra\, Jamra & Hanasab LLP\, and Robin Sax\, J.D.\, LCSW\, of the Law Offices of Robin Sax lead the discussion. Drawing from the perspectives of the bench\, legal practitioners\, and mental health professionals\, the panel will explore how DVRO findings\, whether substantiated\, contested\, or strategically pursued\, can shape custody outcomes\, influence co-parenting dynamics\, and set the trajectory for the case moving forward. \n \nWhile recognizing the critical importance of DVROs as a protective tool in cases involving genuine abuse\, this program also addresses the complex realities courts face when allegations intersect with custody litigation. Topics will include the legal and practical implications of the "rebuttable presumption" against custody\, the impact of resist/refuse dynamics on children\, and the ways in which DVRO proceedings can either clarify or complicate underlying family conflict.

SUMMARY:Can We Show That: Depicting Third-Party IP in Film & Television
DESCRIPTION:Producers\, studios\, and creatives face the same question on every project: when does putting someone else’s trademark on screen require a license\, and what legal and business risks should be considered in deciding whether to proceed without one? Serene Ateek and Tatev Hovhannisyan of Sheppard walk through the anatomy of a trademark infringement claim and the defenses available to TV and film productions. The program also tackles the judgment call: when a use is legally defensible but still carries enough exposure that written permission is the safer path. Attendees leave with a practical framework for advising clients on what trademarks can run as is\, what needs a license\, and what to clear regardless.

SUMMARY:Going for Gold: Venues\, Businesses and the Legal Playbook for the L.A. Olympics
DESCRIPTION:The 2028 Los Angeles Olympics and the 2026 FIFA World Cup have brought California venue and sponsorship agreements into sharp focus\, as facility operators\, rights holders and local businesses navigate overlapping commercial rights. This program examines the legal architecture of venue multimedia rights (MMR) agreements\, covering the rights typically licensed to MMR holders\, category exclusivity and its drafting pitfalls and revenue structures. We will also discuss “clean venue” requirements imposed by major international events such as the Olympics. Finally\, we will take a look beyond the venue walls: how ambush marketing rules and host-city enforcement obligations affect local businesses seeking to capitalize on Olympics-driven attention. David Sunkin and Evara David\, Sheppard Mullin\, will walk through real contractual language illustrating each of these issues. Attendees will leave with a practical framework for advising venue operators\, rights holders\, sponsors and local businesses through each stage of an MMR deal and its intersection with major-event hosting requirements.

SUMMARY:Challenging an Arbitration Award - A Trial Lawyer s Guide to Vacatur
DESCRIPTION:Losing an arbitration is not the same as losing at trial. There is no right to appeal. Courts may confirm awards even in the face of erroneous findings of fact and in some instances\, misapplied law. Dana Welch of Welch ADR and Jiyun Cameron Lee of Folger Levin LLP walk through the narrow grounds that actually support vacatur under both the Federal Arbitration Act and the California Arbitration Act\, including exceeding arbitral powers\, evident partiality and nondisclosure\, refusal to hear material evidence\, manifest disregard of the law\, and awards that contravene public policy. They also cover the deadlines that resolve most petitions before anyone reaches the merits\, including the CAA's 100-day window after Law Finance v. Key and the FAA's three-month service requirement.

SUMMARY:CIPA Website Tracking Claims SB 690 Litigation Defenses And Remediation
DESCRIPTION:On August 28\, 2026\, the California Legislature unanimously passed SB 690\, shifting website and app pen register claims under Penal Code section 638.51 to the Attorney General alone. CIPA's wiretap and recording provisions remain intact\, and plaintiffs are already reframing claims under sections 631 and 632. James D. Snyder\, Managing Shareholder at Klinedinst PC and Co-Chair of the firm's Data Privacy and AI Groups\, explains what SB 690 changes and where exposure remains. He covers consent timing\, the party exception\, vendor liability\, standing defenses\, and forum strategy. Attendees leave with a practical framework for demand letter triage\, remediation\, and settlement.

SUMMARY:The Final Frontier of Data Privacy: Servers in Space and at Sea
DESCRIPTION:NOTE: Can be Privacy AND International \n \nAs data centers face increasing opposition on land\, companies are exploring alternative locations for data infrastructure\, including Earth’s orbit\, the Moon\, and the sea\, which may also offer technical advantages\, including\, for example\, the potential for more energy-efficient cooling. Each environment raises questions that privacy regimes probably never anticipated: when data is stored or processed beyond traditional national territory\, do privacy laws still apply? If so\, which laws apply? And can they effectively be enforced? Francesca Giannoni-Crystal of Crystal & Giannoni-Crystal\, LLC\, examines how the GDPR and U.S. state privacy laws may apply when processing occurs in orbit\, on the Moon\, at sea\, or on the seabed. The discussion also covers the international law frameworks governing outer space and maritime areas\, including the jurisdictional bases that apply depending on where and how data infrastructure is deployed. Under the GDPR\, the analysis centers on the principal bases for application under Article 3. For U.S. state privacy laws\, the focus turns to breach notification obligations and how applicability can depend on the residence of affected individuals rather than the location of the infrastructure. Enforcement is another matter\, and the program explores the gap between prescriptive jurisdiction and enforcement jurisdiction. Attorneys will leave better equipped to identify when privacy regimes attach to unconventional data infrastructure and to raise compliance issues early\, while a project is still on the drawing board.

SUMMARY:Managing the RWI Claim - What Buyers and Sellers Face When the Policy Is Called
DESCRIPTION:Representation and warranty insurance now appears in most middle-market private M&A deals\, yet the available guidance focuses on obtaining a policy rather than using one. When a breach surfaces\, buyers find themselves in unfamiliar territory\, because each policy is custom built around a single deal and the claims process follows dynamics unlike conventional insurance. Jordan Klein of Allen Matkins covers what matters most when a claim arises: giving timely notice\, surviving the insurer's scrutiny of diligence materials for evidence of buyer knowledge at signing\, and calculating loss\, including when an EBITDA-multiple diminution-in-value theory is available and how the Delaware Court of Chancery's 2025 decision in In re Dura Medic supports multiple-based damages. Attorneys will leave able to spot these issues before a deal closes and to manage a claim once one arises.
