Revenue and Taxation Code Section 69.5: Transferring Base-Year Property Values via Proposition 60 & 90
Often overlooked by Real Estate Professionals, Revenue and Taxation Code Section 69.5 allows a homeowner to transfer the existing base year value of a principal residence to a replacement property via Propositions 60, 90, 110. The goal of this presentation is to not only provide an overview of Proposition 60 and 90. but also to outline some of the more nuanced details of these Propositions. Specifically, we will discuss Inter versus Intra County Transfer, the interplay of Revenue and Taxation Code Section 69.5 with Proposition 58 and 193 (Parent to child / Grandparent to child Exclusion), and valuation of replacement property as it relates to remodeling a replacement home. While on its face, this Code Section appears to have been implemented to allow "seniors" to downsize and keep their property taxes stable per Proposition 13, Section 69.5 has far reaching ramifications for estate planning and real estate investment for anyone over the age of 55 and their heirs.
