The program operates under Business and Professions Code sections 6200 through 6206 and the State Bar approved BHBA Rules of Procedure for Fee Arbitrations. - Who can use it: BHBA hears disputes where at least one attorney involved has an office in Los Angeles County or Ventura County, had an office there when the services were provided, or where most of the legal services were performed there. - Who files: Clients usually start the process. Before suing a client over fees, a California attorney must give the client a Notice of Client's Right to Fee Arbitration on the State Bar approved form. - Filing fee: 5% of the amount in dispute, capped at $5,000. The fee becomes part of the dispute and is allocated in the award. Fee waivers are available for parties who qualify. - Binding or non-binding: Arbitration is non-binding unless the parties agree in writing to be bound by the award. - Mediation: Parties can choose to try mediation of their fee dispute through the program. - Arbitrators: Volunteer arbitrators must be active members of the State Bar of California with at least five years of practice. Volunteers can receive complimentary access to BHBA's 25/40-hour Mediation Training. - Contact: mfa@bhba.org - [About the Program](https://bhba.org/arbitration/): Overview of eligibility, fees, and how the process works - [Initiate a Fee Dispute](https://bhba.org/mfa-start): Start a fee arbitration request online - [For Clients](https://bhba.org/arbitration/clients/): What clients should know before and during a fee dispute - [For Attorneys](https://bhba.org/arbitration/attorneys/): Attorney obligations, notices, and responding to a request - [For Volunteers](https://bhba.org/arbitration/volunteers/): Serving as a volunteer arbitrator or mediator - [Arbitrator Application](https://bhba.org/arbitration/apply): Apply to join the arbitrator panel - [Rules, Forms & Resources](https://bhba.org/arbitration/resources/): Program forms, notices, and reference materials - [Program Rules](https://bhba.org/mfa-rules): Full BHBA Rules of Procedure for Fee Arbitrations - [Preparing for a Hearing](https://bhba.org/wp-content/uploads/2025/06/Preparing-for-the-Arbitration-Hearing.pdf): Guide for parties preparing for an arbitration hearing ## Membership - [Levels & Benefits](https://bhba.org/membership/): Compare membership levels, including which levels include unlimited CLE - [New Attorneys & Law Students](https://bhba.org/nextgen/): Free and discounted membership for law students and newer attorneys - [Free CLE Access](https://bhba.org/membership/pro-bono-membership/): Free CLE for public interest lawyers and government employees - [Financial Aid](https://bhba.org/membership/financialaid/): Financial assistance for membership and CLE - [My BHBA+](https://bhba.my.site.com/s/): Free account for registrations, CLE certificates, and credit tracking ## Training - [Mediation Training](https://bhba.org/mediation/): BHBA's 25/40-hour Mediation Training - [Legal Assistant Training](https://bhba.org/legalassistant/): Training in civil litigation, family law, and probate - [Trial Skills](https://bhba.org/product-category/trial-skills/): Trial skills fundamentals and tutorials ## Optional - [Who We Are](https://bhba.org/about/): BHBA history and mission - [Leadership](https://bhba.org/leadership/): Officers and Board of Governors - [The Modern Lawyer](https://bhba.org/modernlawyer/): BHBA's publication with legal updates and practice articles - [Beverly Hills Bar Foundation](https://bhba.org/the-foundation/): Scholarships, the Rule of Law Writing Competition, and pro bono work - [Partners & Providers](https://bhba.org/partners/apply/): Companies that work with BHBA to reach California attorneys - [Jobs Board](https://bhba.org/jobs/): Legal job listings - [Privacy Policy](https://bhba.org/privacy-policy/) - [Terms of Use](https://bhba.org/terms-of-use/) - [Cancellation and Refunds](https://bhba.org/refund-policy/)
