Eavesdropping, Consent, and the Law_ What Every Attorney Needs to Know About Penal Code §632
About the Program

Attorney Arash Hashemi unpacks California’s strict two-party consent rule under Penal Code §632, offering a practical guide to what qualifies as a confidential communication and when recording crosses the line into criminal or civil liability. This program will explore key exceptions—such as public settings, law enforcement, and domestic violence contexts—as well as the consequences of unlawful recording, including exclusion of evidence and potential damages under CIPA.

The Law Offices of Arash Hashemi

Arash Hashemi’s first career goal was to play basketball in the NBA. One day, when he was 14, a family friend commented that Arash would be a good lawyer and should pursue law. Something clicked in Arash’s head and from that day on, he was determined to become a lawyer. In December 2002, Arash was officially sworn in as an active member of The State Bar of California. The very next day, he was in court, taking part in a bench trial, and by March 1, 2003, he established the Law Offices of Arash Hashemi.

Since then, Arash has handled a wide variety of criminal cases—from petty theft to complex felonies, including murder—with a particular focus on self-defense cases. He has represented thousands of Californians accused of violating probation or parole, and has argued before the California Court of Appeals. Arash is admitted to practice before all California State Courts and the United States District Court for the Northern, Eastern, Central, and Southern Districts of California.

In addition to his legal practice, Arash is the host of the podcast “Hashing Out the Law,” where he explores various legal topics and issues. He also served as the president of the Criminal Courts Bar Association for 2024 and regularly volunteers at the Mesereau Free Legal Clinic in South Los Angeles. During his free time, he enjoys playing basketball and photography.
