Dr. Mark Farbman’s second Right of Publicity program begins with a discussion on the remedies available in a successful right of publicity infringement case, including injunctive and monetary relief. Summary tables illustrate the damages allowed in each state that recognizes a statutory right of publicity. The program’s second half addresses the post-mortem right of publicity for estates, focusing on the income valuation method used in a detailed case study of Estate of Michael Jackson v. IRS, U.S. Tax Court (2021). The Jackson decision establishes a step-by-step method for determining the estate valuation of image and likeness (NIL) assets.

Dr. Mark Farbman has a Ph.D. in the field of Textiles Technology and Management from North Carolina State University’s Wilson College of Textiles. His dissertation entitled Inventing The Unified Publicity Rights (2023) is an authoritative research publication about the Modern Right of Publicity. In addition, Dr. Farbman has a J.D. from Tulane Law School and has been practicing civil litigation for nearly 30 years at the Law Office of Mark Farbman in Charlotte, North Carolina. Dr. Farbman is currently establishing himself as a consultant and expert witness in Right of Publicity Law by giving lectures regarding Right of Publicity NIL (name, image and likeness).
