What’s the secret to good legal writing? Spoiler alert – the answer is not AI (yet). Like any craft, writing can be arduous, even for the seasoned practitioner. But the keys to good writing are not hidden. In this session, two experienced litigators (both former federal prosecutors and appellate law clerks) share tried and true tips on how to write persuasively and well. They will cover fundamental topics such as organizing a brief, structuring an argument, improving sentence flow, choosing the right words (and more). Whether you are beginning your legal writing journey or seeking to perfect your skills, this session is for you.
Eric Tung focuses on appeals and motions practice in commercial litigation. He has drafted briefs and motions in federal and state courts, before administrative agencies, and in arbitrations and mediations. He has argued on numerous occasions in federal and state courts around the country at the trial and appellate levels, including the Ninth Circuit, D.C. Circuit, Seventh Circuit, and Florida Supreme Court. His clients include telecommunications, energy, banking, real estate, construction, entertainment, and digital currency companies.
Rasha Gerges Shields is a former federal prosecutor with nearly 20 years of first-chair trial and appellate experience. Rasha defends companies and executives in high-stakes civil and criminal matters, including DOJ and State Attorneys General enforcement actions. She also helps companies conduct internal investigations and develop effective compliance programs. She has been the lead trial counsel in federal court, has argued before the California Supreme Court and federal/state appellate courts, and has submitted amicus briefs to the U.S. Supreme Court as lead counsel.
