Beyond the Merits: Legal Disputes from the Executive Perspective
About the Program

What drives executive decision-making in a legal dispute? Hint: the merits aren’t the primary focus. Instead, corporate leaders weigh broader business realities—market dynamics, leverage, financial pressures, and preserving key relationships, among other criteria, in determining the best course of action. Drawing on decades as a CEO and entertainment executive, Michael Schwimmer offers a candid look at how decision-makers evaluate conflicts, as well as how lawyers can build more loyalty and trust with clients through a deep understanding of their business priorities.

Schwimmer Mediation

Michael Schwimmer is a Mediator and Founder of Schwimmer Mediation. Michael brings a unique combination of experience and skills to his commercial mediation practice: lawyer, corporate executive, and business leader.

After an early stint in business litigation, Michael moved to Brazil and kicked off a decade of
international law practice and corporate counsel roles. Deeply interested in the business of
his clients, Michael transitioned from legal counsel into executive management roles, where
he spent more than 25 years leading both start-up and large-scale media and entertainment
organizations through growth, high-stakes negotiations and the legal disputes that happen
along the way.

Over his career as a CEO, President, and Executive Vice President in media companies such
as TelevisaUnivision, Sling TV, Fuse Media, and Dish Network, Michael was responsible
for the negotiation of a wide range of business agreements across such diverse areas as
intellectual property licensing and distribution, investments, partnerships, M&A, finance,
corporate governance and employment, among many others.
Michael continues to focus on these areas in his dispute resolution practice. Leveraging his
deep practical knowledge and expertise, Michael works tenaciously with counsel and clients
to reach resolution and settlement, providing a steady hand, guidance and—when helpful—
even a bit of humor.

Fluent in Spanish and Portuguese, with extensive experience in Latin America, Michael also
offers a multicultural and international dimension to his mediation practice.
