About the Program

Proposition 65 warnings are everywhere, it seems, but what if your client receives notice that they are supposed to be putting warnings on their products, or in their facilities? We will discuss the formation of Proposition 65, the scope of the litigation it has engendered, and what you can do if your client is informed that they need to provide such warnings.

Barbara Adams is a lawyer who has worked on many different types of legal cases, especially those involving Proposition 65 and lawsuits about asbestos, lead, and mold. She has a lot of experience in court and has been the lead lawyer in more than 100 trials. She has also worked on cases about injuries, faulty products, problems with property, wrongful firing from jobs, and California’s Lemon Law (which protects people who buy defective cars).

Barbara is good at finding ways to resolve legal problems without going to court. She has also worked on appeals in California and federal courts. Because she’s so good at her job, Super Lawyers magazine has said she is one of the top lawyers in the area for many years.

Senior Attorney Hogan Lovells

David Barnes is a litigator and regulatory attorney who concentrates his practice on complex consumer product and environmental matters. He has counseled and represented clients in hundreds of matters involving established California laws such as Proposition 65, while also advising clients on developing environmental laws such as California’s Senate Bill 343 (Environmental Advertising) and Senate Bill 54 (Extended Producer Responsibility).

David represents clients in both federal and state courts. In state court, he has obtained the dismissal of more than 50 matters brought under California Proposition 65 on the basis that private enforcers’ pre-suit notices did not comply with the requirements of the implementing regulations, including the dismissal of 40 related cases via a successful motion for judgment on the pleadings he authored. In federal court, he has represented two plaintiffs who obtained preliminary injunctions against Proposition 65 warnings for acrylamide on First Amendment grounds. Before joining Hogan Lovells and while in law school, David served as first chair prosecutor in a federal criminal matter while interning at the Yosemite National Park Legal Office. He obtained a conviction that was ultimately upheld by the Ninth Circuit Court of Appeals. 1
