About the Program

In a landmark decision on February 11, 2025, U.S. Circuit Judge Stephanos Bibas ruled in favor of Thomson Reuters in its copyright infringement lawsuit against Ross Intelligence. The court determined that Ross’s use of Thomson Reuters’ Westlaw headnotes to train its AI-based legal research tool did not qualify as fair use under U.S. copyright law.

This program examines the court’s reasoning, its interpretation of fair use, and the broader implications for copyright holders and AI innovation.
