About the Program

As online bullying and digital abuse become more prevalent, attorneys are increasingly being tasked with advising victims and litigating claims involving anonymous perpetrators, impersonation, cyberstalking, revenge porn, and other forms of digital abuse.

This program examines the current legal landscape governing online bullying and digital harassment, with an emphasis on practical litigation strategies under California and federal law. It discusses civil remedies available to victims, the challenges of investigating and litigating online abuse, and recent legal developments.

Joseph McNally is Director of Emerging Litigation at McNicholas & McNicholas, LLP, where he leads the firm’s litigation efforts addressing emerging areas of technology-related harm, including social media platform liability, data breaches, online exploitation, sex trafficking, and other catastrophic injuries, as well as the firm’s whistleblower practice in false claims actions. Before joining the firm, McNally spent 18 years as a federal prosecutor, including as Acting United States Attorney and First Assistant United States Attorney in the Central District of California, where he supervised all federal criminal, civil, and national security litigation for the largest judicial district in the country. A fellow of the American College of Trial Lawyers, he has tried 15 cases, spent more than 100 days in trial, and argued before the Ninth Circuit six times, securing convictions against organized crime leaders, corrupt executives, and public officials. His work dismantling a Eurasian organized crime group responsible for a multimillion-dollar bank fraud and identity theft operation earned him the U.S. Department of Justice Director’s Award for Superior Performance. McNally earned his J.D. from UC Berkeley School of Law and his B.S. from Santa Clara University.
