About this program
At trial, deposition transcripts often sit in a box until someone needs a contradiction for impeachment, but that testimony is worth so much more. C.C.P. section 2025.620 lets you put deposition testimony in front of the jury as substantive evidence, including the testimony of any party employee who was employed when the deposition was taken, the testimony of an unavailable witness, and the videotaped testimony of your own expert or a treating physician. Jenna Edzant of Greene Broillet & Wheeler, LLP walks through each subdivision and the objections opposing counsel raises against them. The program covers what “for any purpose” actually means, how to build a record for unavailability starting at the deposition itself, the exceptional-circumstances catch-all, and the notice and designation requirements that decide whether the testimony comes in at all. Attendees will leave knowing the steps for maximizing the value of your deposition transcripts at trial.
