PAGA continues to gain in popularity and complexity. Plaintiffs pursue PAGA claims both in tandem with wage-and-hour class actions and independently, with many employers facing overlapping PAGA claims from different employees. Defense counsel and employers seek ways to stop the claims in their tracks. Meanwhile, courts consider issues of arbitrability, right to jury trials, settlement approval, and intervention in PAGA settlements.
Our speakers, George Abele and Chris Jalian of Paul Hastings, highlight the current disputes and explain the practical impacts on employers, employees, and litigants today. They will provide an advanced look at the statutory history and requirements and issues that regularly arise in litigation.
The program will also focus on the Supreme Court?s hearing of Viking River Cruises, which may determine whether PAGA claims are subject to binding bilateral arbitration, recent legislative challenges to PAGA and how courts are managing competing and overlapping PAGA claims. Chris Jalian is a partner in the Employment Law practice of Paul Hastings and is based in the firm’s Los Angeles office. Admitted to practice in California and New York, Mr. Jalian often acts for national and international companies with workforces spanning the United States. His clients include financial institutions, major manufacturers, hotels and hotel management companies, healthcare providers, entertainment houses, and technology companies.
George Abele is a partner in the Employment Law practice of Paul Hastings and is based in the firm’s Los Angeles office. He divides his practice among his employment litigation and advice, “disaster mitigation,” and appellate practices. Mr. Abele’s employment litigation and advice practice includes the representation of private and public employers in all aspects of employment law, including wage and hour class actions; wrongful discharge, discrimination, and sexual harassment litigation; traditional labor arbitrations; and private arbitrations. He has particular experience in wage and hour class actions and PAGA representative actions. Mr. Abele also helps lead the firm’s disaster mitigation practice, helping his clients undo or significantly reduce disastrous verdicts levied by California juries. His extensive appellate practice serves as a perfect complement to both practices. He is a frequent speaker on a variety of employment law topics.
