This session will highlight the most impactful rulings shaping California’s legal landscape, including developments in contract interpretation, the scope of recoverable damages, arbitration enforcement, judicial review of agency decisions, and other key areas affecting commercial and appellate practice.

Conor Tucker is an experienced litigator who has represented clients at every level of the federal court system — including serving as Counsel of Record before the United States Supreme Court. He has guided cases from the earliest stages of investigation through trial and appeal, and has argued key motions and appeals in both state and federal courts. Conor’s advocacy — in briefing and at argument— has led to published, precedent-setting decisions, including on issues of first impression. In the California Court of Appeal alone, this includes litigating issues of first impression regarding the impact of COIVD-19 on force majeure clauses in live music performance contracts and state regulation of video streaming services. In the United States Supreme Court, he routinely serves as Counsel of Record for Members of Congress as amici and his briefing has been repeatedly covered by SCOTUSBlog and Law360.

He has handled a wide variety of matters, from contract disputes to intellectual property cases involving trademarks, trade secrets, copyrights, and patents, as well as constitutional, criminal procedure, and due process issues. His clients span a broad range of industries, including technology, energy, real estate, retail, apparel, mining, entertainment, banking, healthcare, social media, and computer sciences.

Derek Foran represents public and private companies in complex civil litigation in state and federal courts. Considered a litigation “heavy weight,” his practice focuses on high stakes trials and commercial litigation.

Derek has extensive experience representing clients in complex commercial matters in state and federal trial courts and in private arbitration. Most recently, Derek secured a complete defense verdict on behalf of Lattice Semiconductor in a case seeking over $82 million in compensatory damages. After an 11-day trial the jury returned a verdict for Lattice in less than two hours.

Among other awards, Derek has been recognized as a Northern California Super Lawyer on multiple occasions, named as a Top 100 High Stakes Litigator in Northern California, as well as a Recommended Lawyer in the 2022 edition of Legal 500 US. Clients turn to Derek because he is a “stand out” litigator who provides “excellent and strategic litigation advice.”

Derek also maintains an active pro bono practice. In 2016, he was awarded the Christopher Tietze Humanitarian Award for significant, lifetime contributions in the field of reproductive rights. Prior winners of this award include Supreme Court Justice Harry Blackmun, the ACLU, and three US Senators. His work has been written about in The New York TimesThe Washington Post, and The Los Angeles Times.

Derek is a member of the Board of Governors of the Association of Business Trial Lawyers, Northern California Chapter. He is also a former member of the Board of Directors of Bay Area Legal Aid and the Executive Committee of the Civil Litigation Section of the San Francisco Bar Association.
