About the Program

This program will explore the framework of a prima facie right of publicity case. Drawing from his scholarly publication, “Inventing The Unified Publicity Rights,” Dr. Farbman, PhD will provide a case law analysis of the recent lawsuit alleging name, image, and likeness (“NIL”) theory damages by former college men’s basketball members of the 1983 North Carolina State University NCAA National Champions. This program is designed for all entertainment, in-house Hollywood studio, intellectual property, and sports lawyers to gain an essential understanding of how to apply the correct right of publicity legal framework.

Dr. Mark Farbman has a Ph.D. in the field of Textiles Technology and Management from North Carolina State University’s Wilson College of Textiles. His dissertation entitled Inventing The Unified Publicity Rights (2023) is an authoritative research publication about the Modern Right of Publicity. In addition, Dr. Farbman has a J.D. from Tulane Law School and has been practicing civil litigation for nearly 30 years at the Law Office of Mark Farbman in Charlotte, North Carolina. Dr. Farbman is currently establishing himself as a consultant and expert witness in Right of Publicity Law by giving lectures regarding Right of Publicity NIL (name, image and likeness).
