We will discuss the applicable rules under both the Code of Civil Procedure and the Probate Code for bringing a claim or continuing litigation against a deceased party, and how to avoid miscalculating the period within which you must bring a claim against the decedent – or risk forfeiting it forever. We will also provide instructions on when and how to file a creditor’s claim against a decedent’s estate, and how to initiate a lawsuit against the decedent if your creditor’s claim gets rejected. This program will help plaintiffs and creditors navigate the creditors’ claims procedures, as well as fiduciaries and beneficiaries leverage those procedures to potentially limit liabilities.
